Applying for a new job can be stressful enough on its own, but being denied a position for unlawful or unjust reasons is something no one should ever experience. Unfortunately, disability discrimination is far to common and many individuals in Florida have missed out on opportunities under similar circumstances. A man in another state has recently filed a lawsuit against a logistics company after he was denied a follow-up interview for unjust reasons.
The incident reportedly began when the man showed up for his initial interview after applying for a position within the company. Due to a hearing-related disability, the company chose to reschedule the interview for a later date so that it could provide reasonable accommodation. However, the man says that the follow-up interview never occurred and that he received a message informing him that the company didn't have a position that would be safe for him.
According to reports, the company failed to ask the man about his condition or his ability to perform job-related tasks during any point of the hiring process. The Americans with Disabilities Acts is in place to protect a person against unlawful treatment. A disability discrimination lawsuit was filed against the company, which reportedly resulted in a $50,000 settlement.
Individuals who are subjected to job-related discrimination due to a disability may be entitled to pursue restitution, but the process can be stressful and daunting. Those who experience similar circumstances could find it helpful to consult with an attorney for guidance. An attorney in Florida can review a client's situation and provide guidance on the best course of action with which to proceed.
